3. Data collection on our website

Cookies

This website partially uses so-called cookies. Cookies serve to make our website more user-friendly, effective and secure. Cookies are small text files that are stored on your computer by your browser.

Most of the cookies we use are so-called "session cookies". They are automatically deleted at the end of your visit. Other cookies remain stored on your terminal until you delete them. These cookies enable us to recognise your browser the next time you visit our website.

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies in certain cases or generally and activate the automatic deletion of cookies when closing the browser. When cookies are deactivated, the functionality of this website may be limited.

Cookies, which are necessary to carry out the electronic communication process or to provide certain functions desired by you (e.g. shopping basket function), are stored on the basis of Art. 6 para. 1 f GDPR. The website operator has a legitimate interest in the storage of cookies for technically error-free and optimised provision of its services.

Server log files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us when you visit the corresponding website. These are:

  •     Browser type and browser version
  •     Operating system used, if applicable
  •     Referrer URL
  •     URL called incl. protocol and method
  •     Host name of the accessing computer
  •     Date and time of the server request
  •     IP address
  •     GeoIP Country Code

This data is not combined with other data sources.

The data mentioned will be processed within the server log files in order to realise our legitimate interest (according to art. 6 par. 1 f GDPR). This consists of providing you as a user with functional and (e.g. linguistically adapted to your country) websites, so that our online offering can be presented in an appealing way and constantly optimised. In addition, cyber-attacks can be avoided or averted, error analyses can be carried out and possible cases of fraud can be identified.

The data is processed by an authorised service provider on the basis of an order processing contract under Art. 28 GDPR, in which we have required the service provider to protect our customers' data and not to pass it on to unauthorised third parties. The data will only be processed within the EU and will not be passed on to third parties.

Contact

When contacting the provider (for example by email), your details will be stored for the purpose of processing the enquiry and in the event that follow-up questions arise (Art. 6 Para. 1 f GDPR) until you request the deletion or until the purpose for data storage has been fulfilled. Mandatory statutory provisions - in particular retention periods - remain unaffected.

Google Analytics

This website uses the Google Analytics service, of provider Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

In principle, by using the following services and in connection with the collection of personal data (in particular the IP address), we pursue a legitimate interest in presenting, analysing, improving and adapting possible advertising to your needs on our website (Art.6 Para. 1 f GDPR).

Google Analytics uses "cookies", which are text files placed on the user's computer, to help the website analyse how users use the site. The information generated by the cookie about the use of this website by users is usually transferred to a Google server in the USA and stored there. In principle, by using this service, we pursue a legitimate interest in presenting, analysing, improving and adapting possible advertising on this website in an appealing manner (Art. 6 para. 1 f GDPR).

However, if IP anonymisation is activated on this website, Google will shorten the IP addresses of users within Member States of the European Union or in other states party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. IP anonymisation is active on this website. On behalf of the operator of this website, Google will use this information to evaluate the use of the website by the users, to compile reports on the website activities and to provide the website operator with further services associated with the use of the website and the Internet.

The IP address transmitted by your browser in the context of Google Analytics is not merged with other Google data. Users may refuse the use of cookies by selecting the appropriate settings on their browser. However, this offer points out to users that in this case you may not be able to use all the functions of this website in full. Users can also prevent Google from collecting data generated by the cookie and relating to their use of the website (including their IP address) and from the processing of this data by Google by downloading and installing the browser plug-in available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

You can find more information on data usage for advertising purposes by Google as well as setting and revocation options on the Google websites: https://www.google.com/intl/de/policies/privacy/partners/ (“Data usage by Google when you use websites or apps of our partners”), http://www.google.com/policies/technologies/ads (“Data usage for advertising purposes”), http://www.google.de/settings/ads (“Manage information Google uses to show you advertising”) and http://www.google.com/ads/preferences/ (“Determine which advertising Google shows you”).

Google Web Fonts

This site uses so-called web fonts provided by Google to uniformly display fonts. When you call up a page, your browser loads the required web fonts into your browser cache to display texts and fonts correctly.

To do this, the browser you are using must connect to Google's servers. This gives Google knowledge that our website has been accessed via your IP address. If your browser does not support web fonts, a default font is used by your computer.

For more information about Google Web Fonts and Google's privacy policy, please see the links below: https://fonts.google.com/about and https://www.google.com/policies/privacy/.

Web advertising

Of course, we would like to be found by you based on our content. In addition, we would like to make sure that you don't have to see as much uninteresting advertising on the Internet in the long term. We therefore use service providers who support us in advertising and control. These service providers provide so-called retargeting tools, which store anonymous data on viewed content, store it in cookies on your computer and evaluate it. The evaluation can also take place with visits to other sites, so that advertising banners are shown to you on other sites in line with your past interests. We only collect anonymous data (no names or addresses) that is not assigned to you personally. This is technical information such as the ad frequency and display date of advertising media, the browser used or even the operating system installed. At no time is personal data given to pages on which our advertising is displayed. As far as IP addresses are used, these are shortened, so that you cannot be identified.
We have explained the general options for deleting or preventing cookies using browser settings in the "Cookies" section above.

Further transmission of the data will not take place or will only take place if you have expressly consented to the transmission. Your data will not be passed on to third parties without your express consent, for example for advertising purposes. The basis for data processing is Art. 6 para. 1 b GDPR, which permits the processing of data for the fulfilment of a contract or pre-contractual measures. The postal address is also used for sending catalogues and current offers (Art. 6 para. 1 f GDPR).

If you have consented (art. 6 par. 1 a), we also use a given telephone number for advertising purposes in order to inform you about interesting offers from our company and, in the event of a customer call, to support rapid access to customer data. 4. Data acquisition in the social media

Berkemann GmbH & Co. KG operates its own channels and accounts in various social networks. We uses these presences to increase the public’s awareness of us, to inform various target groups regarding news about our company and our products, and to give interested parties the opportunity to actively assess, comment on, and share our posts.

Herein lies our justified interest, also in relation to the associated data processing on these platforms (pursuant to Art. 6 (1) f GDPR). These include:

Facebook: https://www.facebook.com/berkemann/
Instagram: https://www.instagram.com/berkemann.com.original/
Pinterest: https://www.pinterest.de/berkemann0107/
Youtube: https://www.youtube.com/channel/UClfqCicOpXNqFclW7c5M9SQ
LinkedIn: https://de.linkedin.com/company/berkemann-gmbh-&-co-kg

Regardless of whether you are personally registered with a user account on the respective platform or not, you can view the content of the Berkemann channels and accounts by, for example, clicking on the corresponding link on our website. In general, Berkemann has no influence on which data the respective service providers process, how and why they use the data, or to whom they pass on the data. Therefore, at this point, we would like to expressly advise you that you should use the social media presences offered by us and their functions on your own responsibility and in compliance with the data protection statements of the respective provider:

Facebook: https://www.facebook.com/privacy/explanation
Instagram: https://help.instagram.com/519522125107875
Pinterest: https://about.pinterest.com/de/privacy-policy
linkedIn: https://de.linkedin.com/legal/privacy-policy?trk=d_org_guest_company_overview_footer-privacy-policy

Berkemann regularly receives aggregated statistical information from the platform operators about visitor numbers, click rates, stay durations, and similar things, which the operator supplies us with for analysis purposes and to optimize our presence. Pursuant to the current legal opinion, in this case the service provider and Berkemann are jointly responsible for data processing (see, for example,  https://www.facebook.com/legal/terms/information_about_page_insights_data).

To be able to contact us directly via the social media platforms or to respond to our posts, you must personally possess an account with the respective service provider. You then have the opportunity to assess our posts, comment on them, share them, or to follow us. By means of these activities, we acquire knowledge of your personal data (e.g. usernames and other content from your profile). Remember that dialogs mostly take place on a largely public basis and can be viewable by a large number of people. We therefore urgently recommend that you do not communicate any contact data, sensitive, private information, or similar, either of yours nor of third parties, in this way. Likewise, we can also assess your public posts, comment on them, share them, or follow you. The associated data are made visible to our followers and visitors. Publication or processing that goes beyond this is not intended by us.

Further, by means of the messenger service integrated into the platforms, you can send messages directly to us that cannot be read by other users. However, we advise you that we have no knowledge of how the service provider analyzes, interprets, or otherwise processes these messages.

As an alternative to the social media, especially to the available messenger services, our website www.berkemann.com is of course available to you for all information about the company and our products. Here you will also find contact options that allow you to communicate with us in a nonpublic way (e.g. contact form).
